DCW EDITIONS, a société par actions simplifiée (simplified joint stock company), registered in the Paris Trade and Companies Register under number 502 178 684, whose registered office is located at 71 rue de la Fontaine au Roi, 75011 Paris (hereinafter referred to as “DCWéditions”), grants consumers an additional commercial warranty, under the conditions defined below (the “Commercial Warranty Conditions”).
DCWéditions remains bound by the legal guarantee against hidden defects (articles 1641, 1648 and 2232 of the French Civil Code) and the guarantee of conformity for consumers (articles L. 217-4 to L. 217-14 of the French Consumer Code).
Acceptance without reservation of the present Commercial Warranty Conditions, as well as the laws, regulations and other texts in force in the European Union, is necessary in order to benefit from the present Commercial Warranty. Non-compliance with any of the stipulations of the Commercial Warranty Conditions will prevent the benefit of the commercial warranty.
Consequently, DCWéditions reserves the right to make all necessary verifications concerning the validity and veracity of the information and documents transmitted.
Article 1 – Conditions for benefiting from the commercial warranty
The commercial warranty applies only to :
- A natural person of legal age ;
- Having purchased a product from the 10 HEURES 10 collection as an end user and in his or her capacity as a consumer (hereinafter the “Buyer”);
- With a personal e-mail address ;
- Having completed all the fields of the online form accessible at the URL indicated ;
- Within two (2) calendar months from the date of purchase of the product, provided the corresponding proof of purchase is enclosed.
Once the online form has been completed, the Buyer will receive a warranty number, which must be retained and used in all warranty-related requests.
To benefit from the warranty, the Buyer undertakes to use the product :
- In accordance with the manufacturer’s technical specifications;
- For strictly private use;
- Under technical conditions complying with the manufacturer’s instructions;
- Without modification ;
- By carrying out the necessary maintenance.
The product must be kept in the same condition for as long as is necessary for DCWéditions to check it.
Article 2 – Duration of the commercial warranty
The commercial warranty is valid for four (4) years from the date of purchase.
Article 3 – Contents of the commercial warranty
During the warranty period, the Purchaser may obtain repair or replacement of the product, provided that the malfunction is the result of defective materials or poor workmanship.
DCWéditions alone will decide between repair or replacement.
Article 4 – Implementation of the commercial warranty
To activate the warranty, the Purchaser must notify the retailer where the product was purchased of the malfunction within seven (7) days.
The retailer will contact DCWéditions to implement the warranty.
Article 5 – Exclusion of commercial warranty
Not covered:
- Damage caused by use not in accordance with the manufacturer’s instructions;
- Apparent defects;
- Natural wear and tear, accident, product modification ;
- LED module color defects if within specifications.
Article 6 – Prices
This commercial warranty is free of charge.
Article 7 – Force majeure
The guarantee does not apply in the event of force majeure (natural disasters, pandemics, etc.).
Article 8 – Personal data
DCWéditions complies with current regulations on personal data (RGPD).
The data collected is used exclusively for warranty management and can be deleted on request.
The Buyer may exercise his rights of access, rectification, opposition and deletion by contacting DCWéditions.
Article 9 – Applicable law and settlement of disputes
The present conditions are subject to French law. In the event of litigation, the competent court will be that of the domicile of the Purchaser residing in the European Union or that of DCWéditions.
